#GivingTuesday GIVEaway

To celebrate #GivingTuesday this year, the DonorsChoose.org community is infusing some extra “giving” into the day for 50 DonorsChoose.org users.

When a donor gives to a classroom on November 27, 2018, both the donor and the teacher they support will be entered into our #GivingTuesday GIVEaway. Both will have a chance to win one of 50 $5,000 gift cards (25 for donors, 25 for teachers), backed by the DonorsChoose.org community.

How does the #GivingTuesday GIVEaway work?

  • Donors and teachers who make or receive donations between November 27, 12am ET and November 28, 2:59am ET (midnight for our west coast teachers) will be eligible for the GIVEaway.
  • Every time a donor gives to a project or a teacher page, they’ll be entered into a drawing for one of 25 $5,000 DonorsChoose.org gift cards. The teacher that the donor supports will be entered into a separate drawing for one of 25 $5,000 DonorsChoose.org gift cards.
  • Donations may be of any size (no minimum), and from any source (DonorsChoose.org gift cards, credit cards, Amazon Payments, PayPal, Apple Pay, checks, and account credits).
  • Donors and teachers can each be entered into their respective drawings a maximum of 20 times.


Will matched donations count twice?
Only donations from citizen donors count toward your 20 entries.  Matching funds from our partners or promo code-matched donations will not be counted.

What happens if I support multiple projects at once?
Each project a donor supports will count as one “entry” for the donor, and one “entry” for the teacher. For instance, if a donor checks out once with donations to 22 projects from 22 different teachers in his cart, the donor will be entered the maximum of 20 times into the donor drawing, and each teacher will be entered once (until they reach their 20 entry limit).

I'm a teacher, but I don't have a live project on the site right now.  How can I participate?
Even if you don't have a live classroom project, your friends and family can still head over to your teacher page to purchase a gift card for you to use on a future project, and those donations will count as entries, too!

I’m a teacher, what happens if I donate to my own classroom?
A teacher who donates to their own project will be entered once in the donor drawing and once in the teacher drawing (until they reach their 20 entry limit in either drawing).

What donation methods qualify?
Donations may be of any size, and from any source (DonorsChoose.org gift cards, credit cards, Amazon Payments, PayPal, and account credits).

Check donations qualify for this opportunity, as long as they are postmarked November 27 and arrive at our office before December 4, 2018.  Read our general instructions for donating by check.

Do I have to make a donation to be entered into the Giveaway?
No donation or purchase is necessary to win. Entrants must send a letter with their name, email address, and phone number to DonorsChoose.org at 134 W 37th St. Floor 11, New York, NY 10018 to be entered.

They may also include the name, email address, phone number, and school name of one teacher currently employed at a U.S. public, charter, or Head Start school to be entered into the teacher drawing. Letters must be postmarked November 27, 2018, and must be received by DonorsChoose.org by December 4, 2018 to be eligible.

When will I find out if I won one of the $5,000 gift cards?
We’ll begin drawing winners in the first week of December, and will share a list of winners once all prizes have been claimed.

Official Rules



OVERVIEW.  DonorsChoose.org is a 501(c)(3) charitable organization running the #GivingTuesday GIVEaway (the “Promotion”), designed to engage the public to assist in deciding exactly which classrooms/projects will receive support from $250,000 in classroom funding.  Each winner selected in the Promotion will be able to designate where $5,000 of the funding should be allocated among the various classrooms/projects listed on the Website. No cash awards/prizes are available to winners. See “prize” rule below for complete details.

ELIGIBILITY.  Only legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older are eligible to participate.  In addition, to participate in the teacher’s drawing (see “How to Enter” and “Winner Selection” rules below), you also must be employed as a full-time educator at an accredited U.S. public or charter school where you work directly with students at least 75% of the time and otherwise meet the eligibility requirements for registration on DonorsChoose.org listed here:  https://help.donorschoose.org/hc/en-us/articles/201938006-Which-teachers-can-use-this-site-.  Participation in the consumer drawing doesn’t require employment as an educator.

Not open to employees, officers, directors or trustees of DonorsChoose.org (“Sponsor”), or any of their respective parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Promotion (collectively, the “Promotion Entities”).  Eligibility may be verified at any time. The Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

PROMOTION PERIOD.  The Promotion lasts just one day, November 27, 2018 (“#GivingTuesday”), beginning at 12:00:01 a.m. ET, and ending at 11:59:59 p.m. PT (the “Promotion Period”).  The Sponsor’s database computer is the official time-keeping device for the Promotion.  By participating in the Promotion, you unconditionally accept and agree to comply with these Official Rules.

HOW TO ENTER.    Consumer Drawing:  There are two ways to enter the consumer drawing.  The first is to visit the Website during the Promotion Period and take any of the following three actions:  (i) donate to any listed classroom/project, (ii) purchase a gift card for any listed classroom/teacher to use on the Website, or (iii) purchase a gift card that you (or anyone else) can use later to support any listed classroom/project on the Website.  For each such transaction, you will automatically be entered into the consumer drawing, up to a maximum of twenty (20) transactions/entries. (Donations/purchases made by check/postal mail postmarked on November 27 and received by December 4, 2018 are also eligible.)

Alternatively, you can enter the consumer drawing without any donation or purchase by hand-printing your complete name, postal address, daytime telephone number, email address (if any), and the words “#GivingTuesday GIVEaway Consumer Drawing” on a piece of paper, and mailing it in an envelope with first-class postage to #GivingTuesday GIVEaway, c/o DonorsChoose.org, 134 W. 37th St. Floor 11, New York, NY 10018.  Each postal entry must be mailed separately, postmarked during the Promotion Period (November 27, 2018), and received by Tuesday, December 4, 2018.  No responsibility is assumed for lost, late, stolen, postage due or misdirected mail. A postal entry may designate an entrant into the teacher drawing (see next paragraph), by including the name, school, city, and state of an eligible teacher with a classroom/project listed on the Website during the Promotion Period.  Limit twenty (20) postal entries person.

Teacher Drawing.  An eligible teacher with a classroom/project listed on the Website during the Promotion Period automatically receives one (1) entry into the teacher drawing each time one of the following events occurs during the Promotion Period:  (i) a donation is made to that teacher’s classroom/ project, (ii) a gift card is purchased for that teacher’s classroom/project via the Website, or (iii) a postal entry is submitted in the consumer drawing which names that teacher’s classroom/project.  Limit twenty (20) entries per teacher, regardless of number of eligible transactions or classrooms/projects

General Entry Terms.  Proof of submission is not proof of receipt.  Any information you submit will be subject to the Sponsor’s privacy policy posted at https://www.donorschoose.org/privacy-policy. Limit twenty (20) entries per person and per DonorsChoose.org account per drawing, regardless of method of entry.  Any attempt by a person to enter more than the allowed number of entries by use of multiple identities, addresses, accounts, or any other means, may result in disqualification. No illegible, incomplete, forged, software-generated or other automated multiple entries will be accepted.  No responsibility is assumed for lost, late, stolen, postage due or misdirected mail, or for any failure or interruption in electronic communications.

WINNER SELECTION AND NOTIFICATION.  Two separate drawings will be conducted, one from among eligible entries in the consumer drawing, the other from among eligible entries in the teacher drawing.    Each drawing will randomly select twenty-five (25) winners. The two separate random drawings will be conducted on or about December 5, 2018. The potential winners in each drawing will be notified within approximately 7 days thereafter, using contact information received at the time of entry.  You can only win one (1) time, regardless of the number of entries you have in either or both drawings. No responsibility is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential winner does not respond within 7 days after the first notification attempt, or if the winner notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected.  If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Each potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where legal) a Publicity Release (collectively, “Prize Claim Documents”).  If any eligible winner is not of legal age of majority in his or her state of residence (a “minor”), at Sponsor’s option, the applicable prize either may be awarded in the name of parent or legal guardian of winner, or parent or legal guardian of winner may be required to ratify and sign all Prize Claim Documents.   

PRIZES/ODDS:   Twenty-five (25) prizes are available in each drawing.  Each prize consists of the right to designate where $5,000 of classroom funding will be allocated among classrooms/projects listed on the Website.  The allocation can be to more than one classroom/project. Allocations must be made using a special promotional DonorsChoose.org “gift code” which can be used only on the Website to allocate the designated portion of funding to eligible classrooms/projects.  Except as otherwise provided in these Official Rules, redemptions of such gift codes are subject to the standard Terms of Service on the Website (https://www.donorschoose.org/user-agreement) and the standard procedures for redeeming DonorsChoose.org gift codes (https://www.donorschoose.org/redeem).  Allocations must be completed by March 1, 2019.  Any unallocated funds after that date will be used by DonorsChoose.org to support eligible classrooms/projects of its choosing.  No cash alternative or prize substitutions or transfers will be allowed. Prizes have no cash value to winners.  Allocation to classrooms/projects is not tax-deductible to winners as the allocation is merely among charitable funds already furnished to DonorsChoose.org. Odds of winning in each drawing depend on the number of eligible entries received for that drawing.  Promotion is open to over 100 million internet users in the United States.

GENERAL: Acceptance of a prize constitutes winner’s permission for Sponsor to use winner’s name, photograph, likeness, voice, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation except where prohibited by law.   

No responsibility is assumed for (a) any damage to an entrant’s computer system which is occasioned by accessing the Websites or otherwise participating in the Promotion; (b) any computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays; (c) incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; (d) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; (e) miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; (f) any technical malfunctions, failures, difficulties or other errors of any kind or nature; or (g) the incorrect or inaccurate capture of information, or the failure to capture any information.  

Sponsor reserves the right in its sole discretion to disqualify any individual from this Promotion and any other promotion offered by Sponsor who is found to be tampering with the entry process or the operation of the Promotion or the Website, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.    

In the event of a dispute as to the identity of the entrant, any online entry will be deemed submitted by the authorized account holder of the email account associated with that entry, provided such account holder must still meet the eligibility requirements for the Promotion.  The authorized account holder shall be the natural person to whom the applicable email address has been assigned by the Internet access provider, service provider, or other online organization responsible for assigning email addresses for the domain associated with the submitted email address.  

Sponsor reserves the right to modify, extend, suspend, or terminate the Promotion, in whole or in part, if it determines, in its sole discretion, that the Promotion is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play and/or feasibility of the Promotion as contemplated herein.  If the Promotion is terminated before the designated end date, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

Only the type and quantity of prizes described in these Official Rules will be awarded.  If, for any reason, more bona fide winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the prize category in question may be selected in a random drawing from among all persons making purportedly valid claims for such prize(s).  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

If any provision of these Official Rules is deemed unenforceable by any court of competent jurisdiction for any reason, the remaining provisions shall remain enforceable to fullest extent possible.

RELEASE OF LIABILITY. Entrants (and any minor entrant’s parent or legal guardian) agree that the Promotion Entities (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Promotion or any Promotion-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. However, nothing herein limits liability for intentional or reckless acts or gross negligence, or excludes claims for attorneys’ fees, court costs, or other damages if mandated by statute.  


Governing Law: This Promotion shall be governed by and interpreted under the laws of the State of New York, without regard to its conflicts of laws provisions, except that the arbitration provisions below shall be governed by the Federal Arbitration Act.

Arbitration:  Entrants hereby agree that any and all disputes, claims, causes of action, or controversies (“Claims”) arising out of or in connection with this Promotion shall be resolved, upon the election by entrant or Sponsor, by arbitration conducted by telephone, online and/or be solely based on written submissions without any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties, pursuant to this provision and the code of procedures of either the National Arbitration Forum (“NAF”) or JAMS, as selected by the entrant. IF ARBITRATION IS CHOSEN BY ANY PARTY WITH RESPECT TO A CLAIM, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE THAT CLAIM IN COURT OR HAVE A JURY TRIAL ON THAT CLAIM. FURTHER, NEITHER SPONSOR NOR ENTRANT WILL HAVE THE RIGHT TO PARTICIPATE IN A REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR OTHER PERSONS SIMILARLY SITUATED, OR AS A MEMBER OF ANY CLASS OF CLAIMANTS PERTAINING TO ANY CLAIM SUBJECT TO ARBITRATION. EXCEPT AS SET FORTH BELOW, THE ARBITRATOR’S DECISION WILL BE FINAL AND BINDING. NOTE THAT OTHER RIGHTS THAT ENTRANT WOULD HAVE IF ENTRANT WENT TO COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.  Unless both entrant and Sponsor agree otherwise, the arbitrator may not consolidate more than one person's Claims, and may not otherwise preside over any form of a representative or class proceeding. The arbitrator’s authority to resolve Claims is limited to Claims between Sponsor and entrant alone, and the arbitrator’s authority to make awards is limited to awards to Sponsor and entrant alone. Furthermore, claims brought by either party against the other may not be joined or consolidated in arbitration with Claims brought by or against any third party, unless agreed to in writing by all parties. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.

No arbitration award or decision will have any preclusive effect as to issues or claims in any dispute with anyone who is not a named party to the arbitration. Notwithstanding any other provision in these Official Rules and without waiving either party’s right to appeal such decision, should any portion of this provision be deemed invalid or unenforceable, then the entire provision (other than this sentence and the paragraph below) shall not apply.

Litigation:  If arbitration is not used to resolve a Claim, entrant AGREES THAT THERE WILL NOT BE A JURY TRIAL. ENTRANT AND SPONSOR EACH UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY CLAIM OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THESE PROMOTION IN ANY WAY. IN THE EVENT OF LITIGATION, THIS PARAGRAPH MAY BE FILED TO SHOW A WRITTEN CONSENT TO A TRIAL BY THE COURT. Entrant further agree that, to the extent allowed by applicable law, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, or any prize awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses.  Any litigation relating to these Official Rules or the Promotion shall be brought exclusively in the state or federal courts in New York City, and entrant hereby consents and waives any objection to such jurisdiction.

WINNER LIST.  To obtain a list of winners in either drawing, available after December 31, 2018, send a self-addressed stamped envelope to #GivingTuesday GIVEaway Winners, DonorsChoose.org, 134 W. 37th Street, 11th Floor, New York, NY 10018.  Please designate which drawing(s) you are inquiring about. All such requests must be received by January 15, 2019.
